Terms of Service

1. Acceptance of terms

By downloading, installing, or using the Ghost Trax application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Ghost Trax Ltd (company number 17124252) ("we", "us", "our").

2. The service

Ghost Trax is a GPS ghost-racing application that allows you to record GPS routes as timed "ghosts" and race against them in real time on iPhone and Apple Watch. The service includes route recording, ghost playback, social features (friends, shared ghosts, public routes), and related functionality.

The App is currently in development and some features may be incomplete, unavailable, or subject to change without notice.

3. Account registration

To use Ghost Trax you must create an account with a valid email address. You are responsible for:

• Providing accurate account information.
• Maintaining the security of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately if you believe your account has been compromised.

You must be at least 13 years of age to create an account.

4. Acceptable use

You agree to use Ghost Trax only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Use the App in a way that endangers yourself or others.
• Upload, share, or transmit any content that is unlawful, harmful, harassing, defamatory, or otherwise objectionable.
• Attempt to gain unauthorised access to other users' accounts, routes, or ghost data.
• Use the App to collect or harvest data about other users without their consent.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use the App in any way that could damage, disable, or impair our servers or infrastructure.

5. Your content

You retain ownership of the GPS data, routes, and ghosts you record ("Your Content"). By using Ghost Trax, you grant us a limited, non-exclusive licence to store, process, and display Your Content solely to provide the service to you and, where you have enabled sharing, to other users.

You control the visibility of your routes and ghosts. Content set to "private" is only visible to you. Content shared via link or set to "public" may be visible to all Ghost Trax users.

You may delete Your Content at any time via the App. Deletion is permanent and irreversible.

6. Safety

Ghost Trax involves physical outdoor activity. You are solely responsible for your safety when using the App. You should:

• Be aware of your surroundings at all times — do not use the App in a way that distracts you from road, traffic, or trail hazards.
• Ensure you are physically capable of the activity you are undertaking.
• Obey all applicable laws, road rules, and land access restrictions.
• Not use the App while driving a motor vehicle.

We accept no liability for any injury, accident, or loss arising from your use of the App in connection with physical activity.

7. Intellectual property

The Ghost Trax name, logo, app design, and all software are owned by Ghost Trax Ltd and protected by intellectual property laws. Nothing in these Terms grants you any right to use our intellectual property other than to use the App for its intended purpose.

8. Disclaimers

The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or that GPS data will be accurate. GPS accuracy depends on device hardware, environmental conditions, and third-party services outside our control.

9. Limitation of liability

To the fullest extent permitted by law, Ghost Trax Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, personal injury, or property damage.

Our total liability to you for any claim arising from your use of the App shall not exceed the amount you have paid us in the 12 months preceding the claim.

10. Termination

You may stop using Ghost Trax and delete your account at any time via Settings → Delete Account in the App.

We reserve the right to suspend or terminate your account without notice if you breach these Terms or if we reasonably believe your use of the App poses a risk to other users or the service.

11. Changes to these terms

We may update these Terms from time to time. We will update the "Last updated" date at the top of this page when changes are made. Continued use of the App after changes constitutes your acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of Ghost Trax shall be subject to the exclusive jurisdiction of the courts of England and Wales.
